Preface

The symmetry of real estate and movable property is a legal term. In fact, it is property. It includes immovable buildings with fixed address such as land and houses on it. The division of movable property and real property is based on whether the object can be moved and whether its value is damaged by the movement. Movable property refers to things that can be moved without damaging their value or use. Real estate refers to things that can not be moved or damage their value or use if they are moved. China's long-term implementation of multi department decentralized registration and management mode and system of real estate has led to many problems in real estate registration and management, which are as follows: conflicts in real estate registration rights, low efficiency of real estate registration, incomplete real estate property system, multi-source heterogeneous real estate registration data difficult to share, uneven level of registration information construction, etc. The above problems seriously restrict the state’s overall control and effective management of the real estate situation. 

    Under the background of rapid promotion of the unified registration of real estate in China, this book discusses the connotation of unified registration of real estate according to the principles of registration institution, registration book, registration basis and information platform, studies the division of real estate units and the construction of real estate property right system, and proposes the mode and process suitable for the status quo of real estate registration in China. Based on the above research results, a unified real estate registration information platform has been developed, which has been successfully applied in many provinces, cities and counties in China, providing important technical support for the development of unified real estate registration in China.


前 言

不动产——动产的对称,是一个法律上的名词,其实即是物业,它包括土地及其上之房屋等不可移动,可以有固定地址的建筑物。动产与不动产的划分,是以物是否能够移动并且是否因移动而损坏其价值作为划分标准的。动产是指能够移动而不损害其价值或用途的物。不动产是指不能移动或者若移动则损害其价值或用途的物。我国不动产长期施行多部门分散登记和管理的模式与制度,导致不动产登记及管理存在诸多问题,具体表现为:不动产登记权利存在矛盾冲突,不动产登记效率偏低,不动产物权体系不完整,不动产登记数据多源异构难以互通共享,登记信息化建设水平参差不齐等多个方面。上述问题严重地制约了国家对不动产状况的全面掌握与有效管理。
       在我国快速推进不动产统一登记的背景下,本书依据登记机构、登记簿册、登记依据和信息平台“四统一”的原则,探讨不动产统一登记的内涵,研究不动产单元划分及不动产物权体系构建,提出适合我国不动产登记现状的模式及流程,重点研究不动产登记多源异构数据整合及汇交技术,并基于上述研究成果,研发了不动产统一登记信息平台,在我国多个省、市、县得到成功应用,为我国不动产统一登记事业发展提供了重要技术支撑。

Ning Ping, male, the Han nationality, born in Qiqihar City, Heilongjiang Province in August 1982, bachelor’s degree, national registered surveyor, senior engineer, expert of surveying and mapping geographic information expert database in Heilongjiang Province. At present, he is vice president and deputy chief engineer of Qiqihar Land and Resources Survey, Planning and Design Institute. He presided over and completed the national projects such as the pilot project of unified right confirmation of natural resources and the technical research of rural full coverage right registration, and accumulated rich experience in the registration of the right confirmation of natural resources and real estate investigation.

平宁,男,汉族, 1982 年 8 月生,黑龙江齐齐哈尔人,大学本科学历,国家注册测绘师,高级工程师,黑龙江省测绘地理信息专家库专家。现任齐齐哈尔市国土资源勘测规划设计院副院长、副总工程师。主持完成了自然资源统一确权试点、农村全覆盖权籍调查技术研究等国家级项目,积累了丰富的自然资源和不动产调查确权登记经验。

Ming Xu, male, the Han nationality, bachelor’s degree, born in Linyi City, Shandong Province in August 1974. He graduated from Shandong Agricultural University. His research direction is land engineering. At present, he works in Bureau of Natural Resources and Planning of Yishui County, Linyi City, Shandong Province. He has published 5 papers in national and provincial professional magazines, organized and participated in 2 projects, including land development and consolidation planning of Yishui County, application research of agricultural land classification and comparative analysis method in land re evaluation of land consolidation project, and won the provincial excellent achievement award and the first prize of county science and technology progress award respectively. He has won the titles of advanced worker and excellent Communist Party member of the Bureau for many times.

徐明,男,汉族, 1974 年 8 月生,山东临沂市人,毕业于山东农业大学,本科学历,研究方向为土地工程,现就职于山东省临沂市沂水县自然资源和规划局。在国家、省专业杂志发表论文 5 篇,组织和参与的《沂水县土地开发整理规划》,《农用地分等法和对比分析法在土地整理项目土地重估工作中的应用研究》 等 2 个课题分获省厅优秀成果奖和县科技进步一等奖,多次获得局先进工作者和优秀共产党员等称号。

Pei Geng, male, the Han nationality, on the job postgraduate of Party School of the Central Committee of C.P.C, born in Zhengzhou City, Henan Province in October 1977. At present, he is the director of Zhengzhou Real Estate Mortgage Management Center and the real estate appraisal manager. He has been working in real estate management for more than 20 years, specializing in the practical operation and research of real estate, land, etc.

耿沛,男,汉族, 1977 年 10 月生,河南郑州人,中共中央党校。在职研究生,现任郑州市不动产抵押管理中心主任, 房地产评业管理师, 在房地产管理工作 20 余年,专于地产、房产等不动产域度记实务操作与论研。
